TERMS AND CONDITIONS
The www.traveltobolivia.com website (including any redirections to or from www.traveltobolivia.agency and www.traveltobolivia.tours) (the “Site”) is owned and operated by Travel to Bolivia, Bolivian company. In these booking terms and conditions the expressions “Travel to Bolivia”, “we”, “our” or “us” include Travel to Bolivia and entities that assist or participate with Travel to Bolivia in the provision of the services it agrees to provide (where the context permits, including its and their employee and agents) and the expressions “you”, “your”, “client” or the “passenger” include a person seeking or requiring the services offered by Travel to Bolivia, all other persons (if any) included with that person in the booking and that person’s or those persons’ travel agent (if any). The expressions “Operator” or “Supplier” include any company operating a Travel Product in Bolivia. The expressions “services”, “trip”, “itinerary”, “custom itinerary” or “Travel Product/s” includes all services including but not limited to accommodation, transfers, excursions, cruises, flights and packages that are listed in your booking with us.
- Your booking
Please carefully read and ensure you understand the following terms and conditions. You must not make any booking unless you understand and agree with the following terms and conditions.
- Travel products and availability
By requesting a quote for or booking any services or travel products, you (if booking directly or through a travel advisor) acknowledge and confirm that you have read our booking terms and conditions, that you accept them without reservation as constituting the entire agreement between you and us which cannot be varied other than by an officer of Travel to Bolivia in writing.
We strongly recommend all passengers take out adequate travel insurance for the duration of their travel.
All Travel Products shown on our Sites may be booked, subject to availability at the time of booking.
Considerable care has been taken to compile the information on our Site but circumstances outside of our control may necessitate changes in itineraries or accommodation (e.g. bad weather, social conflicts, hotel being damaged etc.). We reserve the right to cancel or reschedule departures and itineraries if required by circumstances beyond our control. Where it is necessary to change a hotel, we will endeavor to substitute accommodation of no lesser standard.
- Travel insurance
Travel insurance is recommended for all travelers covering all applicable dates of travel with Travel to Bolivia. This insurance must cover; trip interruption, personal injury, medical expenses, evacuation, and repatriation cover including during pandemic events. The choice of insurer is yours. Travel to Bolivia will not be held liable for any costs incurred by the guest resulting from their failure to obtain adequate travel insurance.
- Travel requirements
You are responsible for all immigration, passport, visa, health, quarantine and customs laws, regulations, orders, demands, fees or other requirements of countries visited or transited. You should check the requirements of those countries with their embassies or consulates or other authorities.
Travel to Bolivia bears no responsibility for such information and will not be responsible for advising and/or obtaining required travel documentation for any guest, or for any delays, damages, and/or losses including missed portions of your vacation related to improper documentation or government decisions about entry.
- Force Majeure Events
Force Majeure Event means any event or circumstance beyond the control of Travel to Bolivia, including but not limited to: (a) an act of god (such as earthquake, flood, fire, explosion, landslide, lightning, action of the elements, force of nature, washout, typhoon, hurricane, cyclone, tsunami, storm or storm warning or natural disaster); (b) industrial disputes, work ban or other labor dispute or difficulty; (c) acts of terrorism, political unrest, war or threat of war, riots or civil strife; (d) failure or delays to scheduled transportation and the closure of airports or ports; (e) pandemic, epidemic or health risk; (f) governmental and administrative actions.
- Our site
By using the sites to browse or book any Travel Product, you represent to us that you have read our User Agreement posted on the Site and you accept its application to you.
- Prices on the site
We endeavor to ensure the accuracy of all prices displayed on the Site. Prices are:
-Specified in Americans Dollars (USD).
- Quotes and Customized tours
All written quotes indicate the current price for the Travel Products only, they do not, unless specified, indicate the availability of the Travel Products.
- Exclusions
The price does not include airfares (unless otherwise stated), passport and visa fees, insurance, laundry, phone calls, beverages, meals not detailed in the itinerary, tips to tour guides, motor coach drivers and local guides, items of a personal nature, excess baggage, expenses, fees or costs incurred in case of illness, or of refusal of entry to, detention in, or expulsion or repatriation from a country or part of a country. We are not liable for any expense, costs or loss incurred in relation to such matters and you release us from all liability, damages or responsibility in relation to them.
- Special requests
If you have any bedding requests, dietary requests, allergies or any other special requests, please advise us at the time of booking. Although we will endeavour to pass any reasonable requests on to the relevant supplier, this is not confirmation that the request will be met. All requests are subject to availability.
- Flight reservations
Please contact one of our Destination Experts who will work with you to arrange an experience customized to your needs. We will present to you written quotation for the Travel Products requested.
You must ensure names used to make a booking are exactly as appear in passports. Any name/initial or spelling changes made after booking confirmation may result in supplier-imposed fees and/or you being unable to travel.
- Payments
- Direct booking
If you decided to book one of the Travel Products from our sites which have book bottom, you have to assume that the payment to be charge will be in full. The confirmation of payment will constitute confirmation that you have checked the Travel Products being booked and you have read, understood and agreed to these booking terms and conditions and any terms and conditions specified in the quote.
- Customized quotes
Upon receiving instruction from you that you wish to acquire Travel Products quoted, we will arrange the Travel Products and provide you with a confirmation of their availability and pricing. Your instructions will constitute confirmation that you have checked the Travel Products being booked and you have read, understood and agreed to these booking terms and conditions and any terms and conditions specified in the quote.
4.2.1. For customized itineraries, you must pay:
(A) 30% of the total booking value within 7 business days of us confirming availability and pricing of the Travel Products you request; and
(B) all advance payment amounts we notify you with that confirmation or from time to time in respect of the Travel Products you request and within the time we notify you (e.g. certain Travel Products may require a further payment, up to full payment, to confirm the booking).
4.2.2. Final payment for customized itineraries:
The balance of the price of your booking must be paid no later than 30 days before (or at any time stated by us) your departure. If you fail to make any required payment, we will assume your booking is cancelled.
For bookings within 30 days of departure, full payment is required at the time of request. You acknowledge that we may not be able to confirm services, in which case we will provide you with a refund.
Final documentation will be provided to you as soon as reasonably practicable following receipt of payment in full, all Travel Products being fully confirmed and receipt of all other information required from you, such as emergency contact details or booking registration.
- Credit cards
Any payment by credit card attracts a non-refundable service fee at time of payment, based on the total cost of the payment. The amount of this service fee will depend on the credit card used and will be advised at time of payment.
- Booking changes for customized itineraries:
If you amend your booking after it has been confirmed, you must pay to us:
(A) an administration fee of USD 50, to cover communication and administration costs; and
(B) any cancellation and/or amendment fees imposed by suppliers such as accommodation providers and other suppliers.
- Cancellation
7.1. Cancellations by you
If you cancel your booking after it has been confirmed, but before you utilize the Travel Product, you must pay to us the total of all cancellation fees imposed by the suppliers of your Travel Products (including airlines).
Supplier cancellation fees will vary depending on which Travel Products are included in your custom itinerary. Travel Products that are promoted or discounted by suppliers generally attract a higher cancellation fee.
Below is an indication (based on date of cancellation and your total booking value) of the total cancellation fees (ours and Travel Product suppliers) that will apply:
31-60 day prior to departure: 50% of the total booking value
30-15 days before departure: 75% of the total booking value
15-0 days before departure: 100% of the total booking value
Travel transport providers (such as airlines) generally impose a 100% cancellation fee once a booking is made.
Any payments we have made to third parties or hotels will only be refunded to you once we have deducted the above cancellation fees and charges and once, we have actually recovered the amounts from the third parties. We will use reasonable endeavors to recover third party payments, but we make no guarantee that we will be able to make recoveries.
You agree that these cancellation fees and charges are reasonable and required to protect our legitimate business interests.
7.2. Cancellation due to failure to pay
If payment is not received by the due date/s, Travel to Bolivia the right to cancel your reservation and no refund will be made. Travel to Bolivia will not be responsible for lost land and/or air reservations.
7.3. Cancellation due to events other than Force Majeure Events
If the cancellation by Travel to Bolivia is not as a result of a Force Majure Event, Travel to Bolivia will provide an alternative comparable Travel Product (if available). If an alternative is not available then a refund can be made. Travel to Bolivia is not liable for any cancellation or change cost or penalties incurred on other travel arrangements, including air travel, that may be affected thereby.
Travel to Bolivia not responsible for other travel arrangements that you or your party have made outside Travel to Bolivia and which are affected by our cancellations.
Travel to Bolivia reserves the right, to modify or cancel any trip (definite or not), accommodation, in-destination activity or arrangement at any time.
7.4. Early return, illness or absence
Early return expenses are the passenger’s responsibility. There is no refund for absence or early departure from a Travel Product, including but not limited to missed hotels, transfers, meals or excursions. Travel to Bolivia urges you to purchase travel insurance which covers such circumstances.
- General conditions
8.1. Age restrictions
Young travellers under 18 years of age must be accompanied by an adult, who will be responsible for their welfare and supervision. Travel to Bolivia is not responsible for any losses if you fail to have appropriate documentation.
8.2. Exclusion of liability
To the maximum extent permitted by law, neither Travel to Bolivia nor the supplier nor its agents or affiliated entities will be responsible or liable for cancellations, acts of other service providers, diversions or substitution of equipment or any act, variation, postponement, omission or default by air carriers, land carriers, hoteliers or hotels, transportation companies, or any other persons providing services or accommodations to guests including any results thereof, such as changes in services, accommodations or facilities. Nor shall they be liable for loss or damage to baggage or property, or for injury, illness or death, or for any damages or claims whatsoever arising from loss (including consequential loss), negligence or delay from the act, error, omission default or negligence of any person not its direct employee or under its exclusive control, including any act, error, omission, default, or negligence of any country, government or governmental authority, officer or employee. The released parties shall not be liable for indirect, special or consequential damages.
8.3. Privacy
To process your trip booking, Travel to Bolivia will need to use personal information for you and guests in your booking. Personal information may include each guest’s name, address, phone number, email address, passport number, and sensitive information such as health, medical, dietary, mobility, religious or other special requirements. This personal information may be passed on to other suppliers of your travel arrangements in addition to public authorities (such as customs and immigration), security and credit checking organizations, and otherwise as required by law. We may need to provide personal information to contractors who provide services to or for us (e.g. sending mail, providing marketing assistance, etc). This may involve sending personal information (including sensitive information) to other countries that may not afford the same level of protection of personal information. In making your booking, you consent to your personal data being passed to relevant third parties as set out above.
- Law and jurisdiction
The agreement between us and you in respect of the services to be provided is constituted solely by these terms and conditions and is governed by the laws of Bolivia. We and you submit to the exclusive jurisdiction of the Courts of Bolivia and the Courts of appeal therefrom. In any legal action, arbitration, or other proceeding to enforce, interpret or construe the terms [of this Agreement/and conditions], or concerning any grievance relating to the [tour /booking], the prevailing party shall be entitled to recover its reasonable legal fees and expenses on a solicitor/client basis.
